Audet & Partners, LLP is investigating claims from increasing numbers of consumers as part of a Sherwin Williams Duckback lawsuit that coatings manufactured and sold by Sherwin Williams under the names of “Duckback” and “SuperDeck” were defectively designed and have resulted in consumers having to incur extensive cost in repairing their home decks. Additionally, it has been alleged that the warranties offered by Sherwin Williams for these products essentially violated applicable federal law by offering inadequate relief to consumers.
The products in question, Duckback Deck & Dock Elastomeric Coating and Deck and Dock Solid Coating, and SuperDeck Deck and Dock Coating, have been on the market for several years. In its marketing of these products, Sherwin Williams has promoted the products as empowering the do-it-yourself consumer to “repair and revitalize” their aging decks, rather than having to incur extensive replacement cost.
What consumers have found, however, is that these products are prone to premature cracking, flaking and peeling to an extent that may hasten the need for a complete deck replacement. Consumers have also found that when bringing their experiences to the attention of Sherwin Willams, their concerns have been rebuffed, or a wholly inadequate solution of monetary refund for the cost of the stain has been offered.
