Current Investigations
What are Class Action Investigations?
Class action investigations are investigations into potential and active class action lawsuits. These lawsuits involve numerous plaintiffs who band together against one or a few defendants to recover damages for similar harms. They differ from standard lawsuits in that only one or a few plaintiffs are listed on the lawsuit, but they may represent hundreds or even thousands or millions of others.Numerous Victims
Generally speaking, class actions require numerous victims. There must be enough who have suffered harm to make it impractical or inequitable to have each victim file a lawsuit. For this reason, it is quite difficult to get a judge to certify a class action with too few victims. When only a few of them exist, it is typically better for the plaintiffs to file individual cases to resolve their issues. When there are enough victims, a lead plaintiff is chosen to represent the class of victims. This lead plaintiff will oversee the prosecution of the class action litigation against the defendant or defendants, typically through their class action attorneys.Damages
If the attorneys for the class action are successful, the defendant or defendants will likely be forced to pay monetary damages. It is important to note that although the compensation payout is divided among the group, it is typically not done equally. In other words, every victim in the class action lawsuit will typically get a share of the payout, but the size of the individual payouts is likely to differ from victim to victim. What are some of the factors that affect the size of a class member's payout? They might include:- • The Seriousness of the Injury: Serious injuries get higher compensation
- • Litigation Costs: The law firm’s percentage is claimed before plaintiffs are paid
- • Legal Obstacles: There are very few guarantees in legal battles. Legal obstacles may make it difficult to win a class action
Taxes and Class Actions
If you are in a class action lawsuit and receive money to compensate you for certain losses, you will be pleased to know that the settlement proceeds you receive are usually exempt from federal and state taxes.Types of Class Action Lawsuits
Various types of top class action lawsuits exist to address all manner of wrongs. However, they share the same basic rules regarding plaintiffs, classes, and damages. To explain, here is a class action lawsuits list.Environmental Class Actions
Environmental class actions are common in a world where some of the most profitable companies engage in environmentally risky behavior. When something goes wrong for these companies, the potential for multiple victims to suffer harm is high. For example, a train derailment that spilled hazardous waste in Ohio early in 2023 affected multiple individuals throughout the area. Many of the victims have banded together in a class action lawsuit against the train operator. Other common environmental incidents that may lead to class action lawsuits include:- • Oil and chemical spills
- • Contamination of a water supply
- • Negligent release of chemicals from a factory or plant
Consumer Fraud Class Actions
Consumer fraud can potentially affect millions and typically manifests as:- • False or misleading advertising
- • Consumer protection violations
- • Defective or used products sold as new
Antitrust Class Actions
Class actions against antitrust laws are typically filed against large companies that prevent other businesses and smaller players from enjoying certain economic benefits. For example, John Deere is currently dealing with class action lawsuits filed by customers claiming that the company violated antitrust laws and rules by preventing them or independent repair shops from repairing their tractors.
Defective Products Class Actions
A defective product can lead to significant liability for the product maker and distributor. If the product only harms one or a few people, the victims will likely file individual lawsuits. However, if the product has a widespread distribution and the dangerous defect affects an entire product line or more, then a class action would likely be appropriate. Common defective products include cars and car parts, cosmetics, drugs, food, tools, and electronics. Why Join Class Action Lawsuits?
There are numerous benefits, including financial ones, to joining a class action lawsuit, such as:- • Lower costs of litigation
- • Opportunity for justice
- • Greater odds of getting compensated
- • Representation by lawyers with experience
