AUDET & PARTNERS, LLP Filed a Class Action Complaint Against Sutter Health and Sutter Medical Foundation
AUDET & PARTNERS, LLP filed a class action complaint against Sutter Health and Sutter Medical Foundation (hereinafter collectively referred to as “Sutter”) in Sacramento County Superior Court on December 5, 2011, for violations of the California Confidentiality of Medical Information Act (CMIA), among other statutes.
The case arises out of Sutter’s alleged failure to take adequate measures to properly protect its patients’ confidential medical information. Specifically, a desktop computer containing records regarding the medical diagnoses and/or treatment of just under one million Sutter patients was reportedly stolen or otherwise went missing from Sutter offices in Sacramento on or around October 15, 2011.
In addition to its alleged failure to protect confidential patient medical information through encryption software, Sutter also allegedly failed to notify patients about the breach until nearly one month after the incident in violation of Cal. Civ. Code § 1798.82.
